Time’s nearly up for ‘zombie agreements’
31 May 2023
Following amendments to the Fair Work Act 2009 (Cth), pre-2010 enterprise agreements, referred to as ‘zombie agreements’, will automatically terminate on 7 December 2023.
While ‘zombie agreements’ don't “die” until 7 December, employers must give written notice of this change to affected employees before 7 June.
Please contact the Workplace Relations team or visit the Fair Work Commission website:
- If you have an enterprise agreement that was done before 1 January 2010 that has not been replaced; or
- If you are unsure if you have a ‘zombie agreement’; and/or
- Whether this affects you.
