Changes to building legislation & regulation

The Queensland Government has made several changes to legislation covering building work.
The changes are largely ‘minor technical amendments’ to improve the operation of building legislation.
Of interest to Master Builders is the permanent return of the licensing exemption for a head contractor where the work is non-residential and undertaken by a licensed contractor.
The legislation will also ‘ban the banner’ in developer covenants and body corporate by-laws blocking the installation of solar panels solely based on aesthetics.
It introduces more flexible rules for sewage holding tanks and greywater.
Details of the changes are in the Building and Other Legislation Amendment Bill 2022.
There have also been changes to the Building Regulation 2021. The amendments:
- Extend the exemption to allow building certifiers to hold an external cladding related exclusion on their professional indemnity insurance policies for a further 12 months (until 30 June 2023), and
- Clarify inspection requirements for stages of assessable building work.
